Inadmissibility of counter-submission for lack of authorized representation and prohibition of modifying appeal rulings
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) ordered the rejection of the defendant's written submission as inadmissible and statutorily impermissible, thereby upholding its prior December 2024 decision that had dismissed the defendant's legal complaint (Rechtsbeschwerde) as inadmissible. The dispute concerned a procedural attempt by the defendant to challenge the initial ruling through a "Gegenvorstellung" (counter-submission) filed in January 2025, after the defendant's attorney merely clarified that the submission was not intended as a complaint regarding the lack of a hearing. The court determined the submission was inadmissible under § 78(1) sentence 3 ZPO because it was not filed by an attorney authorized to practice before the BGH, and it was not permissible under the code of civil procedure to modify the earlier decision on the merits, as the prerequisites for a valid complaint for lack of hearing under § 321a ZPO were not met.
