Damages for third-party loss from an ice dome and failure to establish decisional relevance of non-damage finding in non-allowance of revision
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-allowance of revision, upholding the appellate court's judgment and leaving the lower court's decision in force. The dispute concerned a claim for damages related to an ice dome, where the plaintiff challenged the appellate court's finding that neither she nor the assignor suffered any damage, thereby failing to establish the prerequisites for a third-party damage liquidation. Relying on Section 543(2) Sentence 1 and Section 544(6) Sentence 2 Half-sentence 2 of the German Code of Civil Procedure (ZPO), the BGH determined that the case lacked fundamental significance and did not require revision to ensure uniform jurisprudence, specifically because the plaintiff failed to substantiate the decisional relevance of the identified legal errors regarding the damage claim. The plaintiff was ordered to bear the costs of the complaint proceedings, including those of the defendant's co-helper, with a determined value in dispute of approximately €1.2 million.
