Incorporation of prior juvenile judgments into unified juvenile sentences under § 31(2) JGG
Legislator-Zusammenfassung
KI-generiertThe Bundesgerichtshof dismissed the juvenile defendant's revision as unfounded, upholding the sentence of four years and ten months while clarifying the operative part of the judgment to incorporate a prior juvenile court judgment into the unified juvenile sentence pursuant to § 349(2) StPO. The dispute concerned the procedural consolidation of multiple juvenile sentences, where the appellate court reviewed the Landgericht Stuttgart's conviction for criminal offenses. The decisive legal basis was § 31(2) Sentence 1 of the Juvenile Court Act (JGG), which the Senate applied to confirm that the entire prior judgment, not merely the specific penalty, must be integrated when forming the unified juvenile sentence.

Volltext
BGH, Beschluss vom 15. Dezember 2022 – 1 StR 295/22 Rn. 31).
