Statutory bar on state-funded litigation costs for joint prosecutors seeking expense shifting after an acquittal
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Justice (1st Senate) dismissed the joint prosecutor's (Nebenkläger) appeal and immediate complaint as unfounded, thereby upholding the lower court's acquittal of the defendant and its cost order; the joint prosecutor is ordered to bear the costs of their own legal remedies and the defendant's necessary expenses. The dispute centered on the lower court's acquittal of the defendant for multiple counts of serious child sexual abuse and the joint prosecutor's challenge to the allocation of litigation costs. The decisive legal basis for denying the joint prosecutor's request to have their necessary expenses borne by the state treasury is that neither § 467 para. 1 StPO nor § 472 StPO provides for such cost shifting in this context, as the joint prosecutor is not entitled to state-funded representation or cost recovery upon an acquittal.

Aufl., § 472 Rn. 4; KK-Gieg, StPO, 9. Aufl., § 472 Rn. 5).
