Legislator-Zusammenfassung

The German Federal Court of Justice dismissed the complaint of an attorney against the non-admission of revision to the Anwaltgerichtshof Baden-Württemberg, upholding the lower court's decision and ordering the attorney to bear the costs of the legal proceedings. The dispute concerned the mandatory passive use of the special electronic lawyer mailbox (beA) under German Bar Association law, with the attorney arguing that this requirement violated constitutional rights and the right to be heard. The Court ruled that the complaint was inadmissible because the attorney failed to explicitly designate a fundamental legal question or demonstrate that the issue was of general significance, as required by § 145 Abs. 3 Satz 3 BRAO; the Court noted that the beA's passive usage duty had already been established as a constitutionally valid regulation of professional practice by the Federal Constitutional Court and prior BGH precedents, rendering the challenged norm clear and settled.

Volltext

Dezember 1961 - AnwSt (B) 6/61, BGHSt 17, 21, 27 f. und vom 20. März 2007 - AnwSt (B) 6/06, NJW-RR 2007, 1506 Rn. 9; Weyland/Reelsen, BRAO, 11. Aufl., § 145 Rn. 9 ff.). Dem genügt das Vorbringen des Rechtsanwalts nicht. Die in § 31a Abs. 6 BRAO vorgesehene passive Nutzungspflicht des besonderen elektronischen Anwaltspostfachs (beA) ist nach der Rechtsprechung des Bundesverfassungsgerichts (vgl. BVerfG, NJW 2018, 288 Rn. 10 ff.) und des Senats (vgl. BGH, Urteile vom 11. Januar 2016 - AnwZ (Brfg) 33/15, NJW 2016, 1025 Rn. 16 und vom 22. März 2021 - AnwZ (Brfg) 2/20, BGHZ 229, 172 Rn. 99;
