Disciplinary exclusion from the bar: proportionality of sanction and binding effect of prior conviction under limited appeal
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the revision filed by a lawyer, upholding the first-instance decision of the Professional Court of Law (Anwaltsgerichtshof) in North Rhine-Westphalia; the lawyer was ordered to bear the costs of his appellate proceedings. The dispute concerned disciplinary proceedings against the lawyer for alleged breaches of professional duties, specifically challenging the finding of liability and the subsequent exclusion from the bar association. The Court held that the lawyer's attempt to argue he had not solely operated the law firm until May 2018 was irrelevant because it was not raised in a permissible procedural objection, while also noting that the underlying criminal conviction remained legally binding due to a valid limitation of appeal in the prior instance, thus rendering the disputed question of whether a lawyer owes a duty of asset care under § 266(1) StGB moot for sentencing purposes. Relying on the principle of proportionality and considering the lawyer's advanced age and statutory restrictions under § 7 BRAO, the Court further confirmed that the exclusion from the bar association did not violate constitutional rights.
