Classification of successive tax fraud acts as concurrent offenses based on separate defendant actions in transmitting false data
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the appeals of the defendants and the prosecution's appeal concerning one defendant as unfounded, thereby upholding the Landgericht Bochum's conviction and sentencing; the defendants bear their own appeal costs, while the state treasury bears the costs associated with the prosecution's partial appeal. The dispute concerned tax evasion charges arising from the submission of fictitious invoices to an accountant, who then filed false VAT and wage tax declarations on behalf of the defendants. The decisive legal basis was the competition-law assessment (*Wettbewerbsverhältnis*) under German criminal law, which the appellate court confirmed was correctly applied by the trial court; the BGH held that the separate, individual actions of the defendants in transmitting different types of false data (paper invoices versus electronic wage data) to the accountant prior to each filing were sufficiently established to justify the separate convictions rather than a single joint offense.
