The Federal Court of Justice (3rd Criminal Senate) dismissed the defendant's appeal as unfounded, upholding the sentence imposed by the Düsseldorf District Court, with the defendant ordered to bear the costs of the legal proceedings. The dispute centered on a procedural objection challenging the admissibility of evidence derived from EncroChat messages related to cannabis trafficking and acquisition, arguing that these acts did not constitute catalog offenses under § 100b(2) Code of Criminal Procedure at the time of use, and additionally claiming the data's origin was unknown and the lower court's factual assumptions were incorrect. The Court ruled that the primary evidentiary objection failed, referencing recent precedents, and deemed the secondary arguments regarding data provenance and factual premises inadmissible because they constituted new lines of attack that were neither raised within the statutory time limits nor properly substantiated under § 345(1) and § 344(2) Sentence 2 Code of Criminal Procedure.
