The Federal Court of Criminal Justice dismissed the defendant's appeal as unfounded, upholding the Landgericht Stade's July 18, 2024 verdict, but modified the operative portion to exclude the cumulative reference to a prior judgment from May 26, 2021, as directed by the General Federal Prosecutor; the defendant thus prevailed on the narrower issue of the sentence's cumulative basis but lost on the overall challenge to the conviction. The case involved a criminal appeal against a lower court's judgment where the revision focused on procedural errors regarding the aggregation of prior convictions under juvenile criminal law principles. The decisive legal basis for the modification was the requirements for the correct inclusion of prior judgments in sentencing calculations, while the waiver of the defendant's procedural costs was grounded in § 74 JGG (Juvenile Court Act) and the assessment of necessary expenses for the victims was based on § 473 Abs. 1 StPO (Code of Criminal Procedure).

Volltext
