The Federal Court of Criminal Justice (BGH) dismissed the defendant's appeal, upholding the verdict of the Lower Regional Court and ordering the defendant to bear the costs of the appellate proceedings and the necessary expenses of the private prosecutors. The case involved a criminal appeal where the defense challenged the lower court's evidentiary assessment, specifically arguing that the trial court erred by using a previously expunged conviction from the criminal record to the defendant's detriment during the formation of its opinion. The court held that the appeal was unfounded as no disadvantageous legal error was found; while acknowledging that the use of the expunged conviction violated § 52(1) No. 2 of the Federal Exclusion of Criminal Record Act (BZRG), the BGH determined that this error did not affect the outcome because the remaining evidence sufficiently supported the conviction, rendering the legal mistake immaterial under § 349(2) StPO.
