Inadmissibility of hearing complaint for missing statutory deadline and failure to allege specific denial of legal hearing
Legislator-Zusammenfassung
KI-generiertThe BGH 2nd Criminal Senate dismissed the defendant's complaint for lack of hearing as inadmissible at her own costs, leaving the prior Senate decision of January 28, 2025, in force. This decision had originally dismissed the defendant's appeal against the Landgericht Meiningen’s judgment of May 26, 2023, while partially modifying the verdict by applying procedural restrictions under § 154a StPO and reducing two individual sentences pursuant to § 354 Abs. 1a Satz 2 StPO. The complaint was rejected as procedurally defective because the filing failed to meet the one-week statutory deadline under § 356a Satz 2 StPO and substantively failed to demonstrate that the court relied on evidence or arguments without affording the defendant an opportunity to be heard. Although the defendant argued that the court had insufficiently considered the length of proceedings, the Senate determined that this claim was irrelevant for this specific remedy and had already ex officio reviewed the procedural delay, concluding that no compensatory reduction of the sentence was warranted given the complexity and scope of the case.

[GRUENDE]
