Forfeiture of criminal proceeds as a sentencing factor and the exclusion of social security insurance disadvantages from criminal culpability assessment.
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (1st Criminal Division) dismissed the appeals of two defendants as unfounded, upholding the judgment of the Frankfurt am Main Regional Court and ordering each appellant to bear their own legal costs. The case involved criminal charges related to the creation of significant social security contribution and tax damages through labor law violations, where the appellate court examined whether the lower court’s consideration of ancillary insurance-law disadvantages and the ordered forfeiture of criminal proceeds affected the validity of the sentencing. While the BGH noted that the Regional Court’s failure to discount for potential insurance-law harms would not have resulted in a lower sentence given the primary focus on contribution and tax damages, and clarified that considering the forfeiture of criminal proceeds (§ 73c StGB) as a mitigating factor does not burden the defendants, the court affirmed that the significantly reduced individual and aggregate prison sentences from the first instance remain in force.
