Tax evasion in auto trading: applicability of differential VAT taxation for used vehicle purchases and its impact on confiscation scope
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the appeals of the two defendants as unfounded, upholding the conviction and sentencing issued by the Regional Court of Bonn and ordering the defendants to bear their own procedural costs. The dispute involved tax evasion in the context of auto trading, where the defendants allegedly failed to correctly account for Value Added Tax (VAT) on both intra-community acquisitions and the purchase of used vehicles from private individuals. While noting that the lower court erred in failing to apply differential taxation under § 25a Abs. 1 UStG for the limited purchases from private parties, the BGH concluded that this procedural error did not require a reduction in the assessed tax liability or confiscation amount because the affected volume was subordinate to the total evaded tax, which already included a security deduction in favor of the defendants. Furthermore, the court rejected the argument that the sentencing improperly disregarded the aspect of damage compensation, finding no further legal errors to the detriment of the defendants.
