Inadmissibility of Rechtsbeschwerde against rejection of judgment correction under § 319 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's legal complaint as inadmissible, upholding the lower court's refusal to correct a judgment. The dispute concerned a procedural challenge to a correction request under § 319 ZPO, where the plaintiff sought to overturn the lower court's dismissal of that request. The court held the complaint inadmissible primarily on two grounds: it was not filed within the statutory one-month deadline by an attorney admitted to the Federal Court of Justice, and it was substantively barred because the immediate complaint against the rejection of a correction request under § 319 Abs. 3 ZPO is not statutorily permitted. Consequently, the lower court’s decision dismissing the correction application remains in force.
