The Federal Court of Criminal Senate ordered the transfer and merger of a pending district court proceeding into a regional court proceeding, effectively allowing the regional court to assume jurisdiction over the consolidated case. The dispute concerned procedural consolidation, where two separate criminal cases against the same defendant were pending in different jurisdictions: one at the District Court (Schöffengericht) in the Braunschweig district and the other at the Regional Court (große Strafkammer) in the Köln district. The transfer was authorized by the joint prosecuting authorities and deemed necessary because the criminal allegations in both proceedings directed against the same defendant required unified investigation and adjudication for the sake of comprehensive clarification. The decision was grounded in §§ 2, 3, and 4(2) of the Code of Criminal Procedure (StPO), which permit the joint superior court of the respective districts to order the merger of proceedings to ensure procedural efficiency and consistency.
