Denial of legal aid for package travel damages claim due to lack of success prospects and requirement of court-admitted counsel
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's applications for legal aid and the assignment of a counsel, leaving the lower court's rejection of the plaintiff's appeal for lack of legal representation in force. The dispute arose from a package travel contract where the plaintiff sought damages; after the regional court dismissed the plaintiff's objection to a default judgment, the higher regional court rejected the application for legal aid and dismissed the appeal as inadmissible because it was not filed by a lawyer. The Supreme Court held that the intended legal action lacked the required prospect of success under Section 114(1) Sentence 1 of the Code of Civil Procedure, thereby denying legal aid and counsel assignment under Sections 114 and 121 of the Code of Civil Procedure, and noted that a legal complaint would be inadmissible without a lawyer admitted to the Federal Court of Justice.
