Admissibility of legal remedy against appellate judgment under § 304 StPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) rejected the complainant’s *Gegenvorstellung* (challenge to a denial of leave) filed against its own prior decision of January 7, 2025, thereby leaving the Oberlandesgericht Hamm’s ruling in force and warning that further submissions will no longer be answered. The dispute concerned the admissibility of a *Beschwerde* (legal remedy) against the OLG’s decision in a matter where the OLG acted as an appellate court, with the complainant arguing that exceptions allowing such review applied to their case. The court determined that under § 304 Abs. 4 Satz 2 Halbsatz 1 StPO, the OLG’s judgment was removed from the scope of *Beschwerde* review because the cited exceptions in § 304 Abs. 4 Satz 2 Halbsatz 2 and § 304 Abs. 5 StPO only apply to cases within the OLG’s jurisdiction in the first instance or to specific rulings by the investigating judges of the BGH/OLG, neither of which applied to this appellate matter.
