The Bundesgerichtshof dismissed the plaintiff’s complaint against the non-admission of revision, thereby leaving the appellate decision of the Schleswig-Holsteinisches Oberlandesgericht in force and ruling in favor of the defendant. The dispute concerned a civil matter where the plaintiff argued that the case possessed fundamental legal significance due to unsettled questions of European law, following a prior suspension of proceedings by the Senate. The court held that the alleged grounds for admission of revision no longer existed because the decisive European legal issues had been conclusively resolved by a 2023 Court of Justice of the European Union ruling (BMW Bank) and a subsequent 2024 BGH Senate judgment, making a revision both legally unnecessary and devoid of prospects of success; the court ordered the plaintiff to bear the costs of the complaint proceedings based on § 97 Abs. 1 ZPO, with the amount in dispute fixed at €41,817.84. The decision relied on § 543 Abs. 2 Satz 1 Nr. 1 ZPO regarding the requirement of fundamental legal significance and § 544 Abs. 6 Satz 2 ZPO regarding the waiver of further reasoning, establishing that the issue was settled by superior jurisprudence.
