Admissibility of procedural objections to unlawful evidence utilization without prior objection in the main hearing
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Criminal Fourth Senate dismissed the defendant's appeal, upholding the district court's conviction and ordering the defendant to bear the costs of the legal remedy. The dispute concerned procedural objections alleging violations of Article 10 of the Basic Law and Sections 163f and 105 of the Code of Criminal Procedure regarding the utilization of unlawfully obtained evidence. The court ruled the procedural objections inadmissible because the represented defendant failed to lodge a formal objection to the evidence during the main oral hearing, a prerequisite for challenging such procedural defects; the court further determined that this domestic procedural requirement does not conflict with EU law regarding the modalities for claiming misuse of unlawfully obtained evidence, rendering a reference to the Court of Justice of the European Union unnecessary.

Verfahrensrüge bei fehlendem Widerspruch in Hauptverhandlung
[TENOR]
