Non-admission complaint rejected for lack of fundamental legal significance and negative revision prospects
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff’s non-admission complaint, thereby upholding the lower court’s refusal to allow an appeal to revision and leaving the underlying judgment in force. The dispute involved a civil matter where the plaintiff challenged the appellate court’s determination that the case lacked fundamental legal significance or a need for uniform jurisprudence. Relying on § 543 Abs. 2 Satz 1 ZPO, the court found that the success prospects of a potential revision were negative, a conclusion it verified in accordance with constitutional standards, and it referenced recent binding precedents from the same senate to justify its decision without further detailed reasoning. The plaintiff was ordered to bear the costs of the complaint proceedings, and the disputed amount was assessed at up to €50,000.
