Reinstatement after missed appeal deadline due to ineffective judgment service lacking required court official signature
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (6th Criminal Senate) granted the defendant's application for reinstatement to the former status prior to the expiration of the appeal deadline and waived the imposition of costs for reinstatement under § 74 JGG. The case involved a juvenile defendant convicted of aggravated bodily injury, who, through his defense counsel, filed an appeal and reinstatement request after inadvertently miscalculating the deadline as June 18 instead of the earlier expiration date. The court held the application admissible and well-founded because the counsel demonstrated within the statutory period of § 45 Abs. 1 StPO that the defendant was not at fault for the missed deadline and properly performed the missed legal act per § 32d StPO. Furthermore, the court ruled that the service of the judgment by the Landgericht Rostock was ineffective due to a violation of § 273 Abs. 4 StPO, as the required signature of the recording officer was missing from the protocol pursuant to §§ 271 and 273 StPO; consequently, the matter was remanded to the Landgericht for the continuation of the appeal proceedings and proper service of the judgment.
