Non-admission of revision dismissed due to unchallenged legal basis underlying the rejection of delictual claims in the appeal
Legislator-Zusammenfassung
KI-generiertThe BGH 6th Civil Senate dismissed the plaintiff's complaint against the non-acceptance of revision, upholding the lower appellate court's rejection of the plaintiff's appeal, with the plaintiff bearing the costs of the complaint proceedings. The dispute involved a challenge to a decision regarding delictual claims, where the plaintiff appealed the district court's judgment. The decisive legal basis was the procedural unacceptability of the appeal, as the plaintiff failed to challenge the specific reasoning in the district court's decision that supported the dismissal of all delictual claims, a defect the appellate court was required to examine ex officio, rendering the appeal inadmissible without need for further examination of fundamental significance.
