The BGH 8th Civil Senate dismissed the defendant's revision, thereby upholding the Landgericht Kiel's judgment and leaving the defendant liable for the costs of the appellate proceedings. The dispute concerned an energy supply contract, specifically whether a landlord is liable to an energy supplier for the costs of basic supply when individual rooms within a rented apartment are leased out and lack separate utility meters. The court rejected the appeal under § 552a Sentence 1 ZPO, finding that the requirements for admitting revision under § 543 Abs. 2 Sentence 1 ZPO were not met and that the appeal had no prospect of success, a determination based on the principles established in a prior Senate order from February 2025 regarding landlord liability for sub-letting of residential units without individual metering.
