Inadmissibility of a repeated complaint for violation of the right to be heard against a decision rejecting a prior such complaint
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) 4th Criminal Senate dismissed the appellant's renewed *Anhörungsrüge* (complaint for violation of the right to be heard), with costs imposed on the convicted party. The dispute concerned a prior BGH decision from September 10, 2024, which had already rejected an initial complaint alleging a violation of the right to be heard under Article 103(1) of the German Basic Law in connection with the handling of the appellant's revision against a lower court judgment (which had resulted in the remand of the confiscation portion of the case). The court held that a second *Anhörungsrüge* directed against a judgment that rejects a previous *Anhörungsrüge* is procedurally inadmissible (*unstatthaft*), relying on established case law from the Federal Constitutional Court and the BGH. Because the renewed complaint was legally barred, the court deemed it unnecessary to assess whether the alleged procedural violation was substantively correct.

Die Anhörungsrüge vom 9. Oktober 2024 gegen den Beschluss des Senats vom 10. September 2024 wird auf Kosten des Verurteilten zurückgewiesen.
[GRUENDE]
