Inadmissibility of auxiliary plaintiff's revision seeking to expand guilt scope by adding unadjudicated murder characteristic
Legislator-Zusammenfassung
KI-generiertThe BGH Fourth Criminal Senate dismissed the auxiliary plaintiffs' appeals as inadmissible, ordering each appellant to bear their own legal costs, leaving the Landgericht Siegen's conviction for murder and the nine-year juvenile sentence in force. The dispute concerned the auxiliary plaintiffs' challenge to the first-instance court's rejection of the murder characteristic of low motives ("niedrige Beweggründe"), despite the court already having established the characteristic of treachery ("Heimtücke") to classify the offense as murder. The appeals were deemed inadmissible under § 349 Abs. 1 StPO because, pursuant to § 400 Abs. 1 StPO, auxiliary plaintiffs may not file revisions aimed at altering the legal consequences of a crime; their attempt to expand the scope of guilt by adding a rejected murder characteristic was determined to be a prohibited challenge to the sentencing outcome rather than a valid amendment of the guilty verdict regarding an auxiliary plaintiff's specific delict.

August 2023 – 4 StR 137/23; vom 28. Juni 2022 – 3 StR 123/22 Rn. 3 mwN, Rn. 4 mwN).
