Brokerage fee split exemption for single-family homes: eligibility of multi-unit residential properties under §§ 656a ff. BGB
Legislator-Zusammenfassung
KI-generiertThe Bundesgerichtshof (BGH) dismissed the defendants' complaint against the non-admission of a constitutional appeal, leaving the lower court’s judgment in favor of the plaintiff broker in force and ordering the defendants to bear the costs of the appellate proceedings. The dispute concerned a brokerage agreement for a property comprising two ownership units, where the defendants argued that the property qualified as a single-family home under German civil law, thereby exempting them from paying the broker’s fee due to the statutory prohibition on half-splitting fees for such residential units. The court held that the right to a half-split applies only if the acquisition was intended for the residential purposes of a single household, as recognizable to the broker at the time of contract conclusion; because the property contained two significant ownership units, the broker could not have assumed a single-household residential purpose, and the appeal lacked fundamental legal significance given recent precedents clarifying that the purchaser’s intent and the property’s physical structure are decisive for this classification under §§ 656a ff. BGB.

März 2025 (I ZR 32/24, juris) geklärt. März 2025 - I ZR 32/24, juris Rn. 17).
III. BGH, Beschluss vom 6. Mai 2004 - I ZR 197/03, GRUR 2004, 712 = WRP 2004, 1051 - PEE-WEE; Beschluss vom 15. Oktober 2020 - I ZR 206/19, juris Rn. 2). März 2025 - I ZR 32/24, juris Rn. 23).
IV. Die Kostenentscheidung folgt aus § 97 Abs. 1 ZPO.
