The Federal Court of Criminal Procedure (BGH), 1st Criminal Senate, dismissed the defendant's revision as unfounded, upholding the Landgericht Aachen’s judgment of 26 February 2024 and ordering the defendant to bear the costs of the legal remedy. The case involved a challenge to a drug trafficking conviction, specifically contesting the appellate court’s determination of the statutory sentencing framework and the specific aggravating factors applied during sentencing. The decisive legal basis concerned the interpretation of § 349 para. 2 StPO and the doctrinal classification of the narcotic substance MDMA (Ecstasy); the BGH held that the trial court’s characterization of MDMA as a drug of increased danger rather than a "soft" drug was legally sound as a distinction from low-harm substances and did not materially aggravate the sentence independently of the massive quantitative excess, which exceeded the non-small amount by factors ranging from 90 to 186.

Volltext

Soweit das Landgericht sowohl bei der Bestimmung des Strafrahmens als auch bei der Strafzumessung im engeren Sinn im Rahmen der Prüfung der straferschwerenden Gesichtspunkte berücksichtigt hat, „dass es sich bei Ecstasy nicht um eine sogenannte weiche, sondern eine Droge erhöhter Gefährlichkeit handelt“, besorgt der Senat nicht, es habe verkannt, dass der Wirkstoff MDMA auf der Gefährlichkeitsskala einen mittleren Platz einnimmt und daher für sich betrachtet keinen wesentlichen Strafschärfungsgrund darstellt (vgl. BGH, Urteil vom 15. Dezember 2022 – 3 StR 295/22 Rn. 30 f.;

Beschluss vom 14. Februar 2024 – 2 StR 493/23 Rn. 4 f.; jeweils mwN).
