Sentencing for drug aid: Mischaracterization of MDMA’s danger level and application of the mitigated statutory framework under § 29a Abs. 2 BtMG
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (1st Criminal Senate) dismissed the defendant's appeal as unfounded, upholding the sentence imposed by the Aachen Regional Court and ordering the defendant to bear the costs of the legal remedy. The dispute concerned a conviction for drug offenses under the Narcotic Drugs Act, specifically challenging the sentencing rationale which allegedly mischaracterized the substance Ecstasy (MDMA) as possessing heightened danger rather than a middle position on the danger scale, and criticized the imposition of the statutory maximum of five years' imprisonment within the framework for less serious cases of aid. The court held that the lower court's characterization of the drug's nature was legally sound as a distinction from "soft" drugs and did not constitute an error affecting the outcome, given the substantial excess over the "not small quantity" threshold and the weight of the aiding conduct; furthermore, the sentencing rationale was sufficient because the trial court had applied the statutory mitigation provision for accomplices (§ 27 StGB) and expressly selected the more favorable sentencing framework for less serious cases under § 29a para. 2 BtMG over the standard framework, justifying the maximum sentence within that specific range.

Soweit das Landgericht sowohl bei der Bestimmung des Strafrahmens als auch bei der Strafzumessung im engeren Sinn im Rahmen der Prüfung der straferschwerenden Gesichtspunkte berücksichtigt hat, „dass es sich bei Ecstasy nicht um eine sogenannte weiche, sondern eine Droge erhöhter Gefährlichkeit handelt“, besorgt der Senat nicht, es habe verkannt, dass der Wirkstoff MDMA auf der Gefährlichkeitsskala einen mittleren Platz einnimmt und daher für sich betrachtet keinen wesentlichen Strafschärfungsgrund darstellt (vgl. BGH, Urteil vom 15. Dezember 2022 – 3 StR 295/22 Rn. 30 f.;
Beschluss vom 14. Februar 2024 – 2 StR 493/23 Rn. 4 f.; jeweils mwN).
