The Federal Court of Justice rejected the convicted defendant's motion for a hearing (*Anhörungsrüge*) as inadmissible, leaving the lower court's decision and the appellate panel's prior dismissal of the appeal intact. In this criminal proceeding, the defendant challenged the panel's February 2025 decision that had dismissed his revision against the Augsburg Regional Court's August 2024 judgment; however, the defendant failed to substantiate a claim that the appellate panel violated his right to be heard in the handling of the case. The court held that the procedural requirements of § 349(2) and (3) StPO were fulfilled by the panel's reliance on the General Public Prosecutor's exhaustive response to the revision arguments, meaning no breach of the fundamental right to legal hearing under Article 103(1) of the Basic Law occurred, rendering the motion inadmissible under § 356a StPO.
