Consideration of pre-decree cannabis possession conviction as sentencing factor under the new Cannabis Act
Legislator-Zusammenfassung
KI-generiertThe BGH 4th Criminal Senate dismissed the defendant's appeal, upholding the Landgericht Bielefeld's conviction and sentence for drug offenses. The dispute concerned whether a prior conviction for possessing 51.24 g of cannabis could be considered in sentencing after the decriminalization of small-amount possession for personal use. The Senate acknowledged that the lower court erred in using this prior conviction, which no longer constitutes a criminal offense under § 34 Abs. 1 Nr. 1b KCanG, as an aggravating factor. However, the appellate court held that this legal error did not affect the outcome, as the sentence was primarily determined by the substantial and professional nature of the current offense, involving a quantity exceeding the non-small-amount threshold by more than 350-fold. Consequently, the final judgment remains in force, with the defendant ordered to bear the costs of the appeal.
