Insufficiency of reasoning for aggregate sentence where prior substitution of custodial sentence for a fine was not explicitly cited in the judgment
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) rejected the defendant's appeal, upholding the Berlin Regional Court's criminal conviction and sentencing. The dispute centered on a procedural objection regarding the court's insufficient reasoning for the aggregate sentence, specifically the unexplained inclusion of a concurrent substitute custodial sentence. The court held that the lower court's reference to a 2022 aggregate custodial sentence and the absence of a subsequent monetary penalty in the indictment were sufficient to negate the claim that a prior fine was eligible for inclusion under § 55 StGB, finding no error of law to the defendant's detriment. The appellate ruling affirmed the original judgment, ordering the defendant to bear the costs of the appeal.
