§ 37 Abs. 1 WHG applicability where terrain slope for surface water flow is created by the challenged measure rather than pre-existing naturally
Legislator-Zusammenfassung
KI-generiertThe Third Civil Senate of the Federal Court of Justice (BGH) dismissed the defendant's complaint against the refusal to admit an appeal to the Federal Court of Justice (Revision) in a dispute concerning the legal requirements for water management measures under § 37 Abs. 1 of the German Water Resources Act (WHG). The core legal issue was whether the statutory provision applies when a natural terrain slope necessary for the natural flow of surface water is only created by the challenged measure itself, rather than existing beforehand. The court held that § 37 Abs. 1 WHG presupposes the existence of a natural terrain slope prior to the intervention; consequently, the provision is not applicable if the slope is manufactured by the measure in question. However, the BGH found no compelling grounds for admitting the appeal, noting that even a different legal interpretation would not have changed the outcome of the prior instance decision by the Stuttgart Higher Regional Court. The defendant was ordered to bear the costs of the complaint proceedings.

Beschwerdewert: 30.000 €.
