Civil litigation leave-to-appeal rejection for lack of fundamental legal significance under § 543(2) ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) rejected the defendant's complaint against the non-admission of leave to appeal, thereby upholding the lower court's judgment and dismissing the case; the dispute concerned a civil matter where the plaintiff prevailed in the appellate proceedings before the Oberlandesgericht Frankfurt. The court held that the subject matter did not raise questions of fundamental legal significance, nor was an appellate decision necessary for the further development of law or the assurance of consistent jurisprudence, citing § 543(2) ZPO as the decisive legal basis for refusing admission. Consequently, the defendant was ordered to bear the costs of the complaint proceedings under § 97(1) ZPO, and the value in dispute for the complaint proceedings was fixed at €27,627.71.
