Inadmissibility of leave-to-appeal application for missed two-month justification deadline in bar license revocation
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff’s application for leave to appeal as inadmissible, thereby upholding the lower court’s judgment and leaving the revocation of his attorney license in force. The dispute concerned the revocation of the plaintiff’s admission to the legal profession due to loss of assets, a decision originally made by the bar association and upheld by the Regional Attorney Court (Anwaltsgerichtshof) of North Rhine-Westphalia, which rejected the plaintiff's annulment suit. The BGH found the application procedurally defective because the plaintiff failed to file the required justification within the two-month statutory period, which expired without extension. The decision rests on §§ 112e, 112c, and 194 of the Federal Lawyers’ Act (BRAO) in conjunction with §§ 124a and 125 of the Administrative Court Procedure Act (VwGO), specifically regarding the admissibility of leave to appeal and the strict application of filing deadlines.
