Inadmissibility of criminal appeal for incomplete reproduction of evidence rejection order and failure to submit expert report
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) 1st Criminal Senate dismissed the defendant's appeal as unfounded, upholding the Landshut Regional Court's judgment and ordering the defendant to bear the costs of the appellate proceedings and the victim's necessary expenses. The case involved a criminal trial where the defendant challenged the lower court's refusal to admit a specific piece of evidence regarding soil or grass fragments found on the deceased's clothing, arguing that this constituted a procedural error and a violation of the court's duty to clarify the facts ex officio. The dismissal was based on the legal principle that procedural complaints are inadmissible if the appellant fails to fully reproduce the content of the relevant judicial order or submit essential documents referenced in the appeal, specifically the final paragraph of the evidence rejection order and the associated expert report on the origin of the soil adhesions, which had been read into the record during the main hearing.
