Consumers' right of withdrawal under credit directive extinguished by full performance of loan agreement
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiff's complaint for non-admission of revision, thereby leaving the lower court's decision in force against the plaintiff, who bears the costs of the appellate proceedings. The dispute concerned a consumer loan where the borrower attempted to exercise a statutory right of withdrawal after the credit agreement had been fully performed; the core issue was whether such a withdrawal right persists after complete execution of the contract. The court ruled that no right of withdrawal exists under Article 14(1) of Directive 2008/48/EC (Consumer Credit Directive) once the loan agreement is fully fulfilled, aligning with established jurisprudence of the Court of Justice of the European Union and prior BGH precedent, and found no need for further reference to the European Court of Justice or for the development of the law to ensure uniform interpretation.
