The German Federal Court of Justice (BGH) dismissed the defendant's motion for hearing (Anhörungsrüge), leaving the appellate court's judgment in favor of the patent holders fully in force and imposing the costs on the defendant. The dispute concerned a patent infringement proceeding where the defendant challenged the appellate court's interpretation of the patent claim, specifically arguing that the lower court had adopted the plaintiff's understanding of claim feature group 9 without sufficient justification, and claimed a violation of their right to be heard due to a misunderstanding of the presiding judge's introductory remarks on the state of facts. The court held that no violation of the right to be heard occurred because the appellate court had comprehensively reasoned its provisional interpretation, which aligned with the plaintiff's position, and the defendant's alleged misunderstanding was not apparent to the court, thus failing to meet the threshold for judicial intervention under established doctrine; the decision is grounded in § 97 ZPO regarding costs and general principles of due process in civil proceedings.

IV. Die Kostenentscheidung folgt aus § 97 ZPO.
