The Federal Court of Justice (BGH) dismissed the plaintiff’s application to suspend proceedings and rejected the plaintiff’s appeal against non-admission, thereby upholding the lower court’s decision that the plaintiff was not entitled to a right of withdrawal. The dispute concerned a consumer credit agreement where the borrower argued for a right of revocation under Article 14(1) of Directive 2008/48/EC. The material facts established by the lower courts indicated that the loan agreement had been fully performed and repaid before the borrower exercised the alleged right of withdrawal. The court held that under the case law of the Court of Justice of the European Union and the BGH’s own recent precedent, no right of withdrawal exists for the borrower under the Consumer Credit Directive once the credit contract has been fully performed; consequently, the legal issue lacked fundamental significance or a need for uniform legal interpretation, resulting in the rejection of the non-admission appeal and an order for the plaintiff to bear the costs of the appeal proceedings.

Dezember 2023 - C-38/21, C-47/21 und C-232/21, juris Rn. 274 - 279, 292 - BMW Bank u.a.; Senatsurteil vom 28. Januar 2025 - XI ZR 162/21, juris Rn. 12 ff. mwN). Von einer weiteren Begründung wird gemäß § 544 Abs. 6 Satz 2 Halbs. 2 ZPO abgesehen.
