Consumer credit: Existence of withdrawal right under Directive 2008/48/EC after full repayment of the loan
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiff’s application to suspend the proceedings and rejected the plaintiff’s non-admission complaint, thereby upholding the appellate court’s decision and ordering the plaintiff to bear the costs of the complaint proceedings. The dispute concerned a consumer loan contract and the borrower’s attempt to exercise a right of withdrawal after the loan had already been fully repaid. Relying on the Court of Justice of the European Union’s recent jurisprudence, the BGH held that a right of withdrawal under Article 14(1) of Directive 2008/48/EC does not exist for the borrower after the complete performance of the loan contract. Consequently, the court found no fundamental significance in the legal question, nor was there a need for the development of law or uniform jurisprudence to justify a revision.
