Criminal revision: evidentiary weight of testimony from preliminary investigation in lieu of oral witness hearing
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the defendant's criminal appeal as unfounded, leaving the conviction from the Landgericht Saarbrücken in force, and ordered the defendant to bear the costs of the legal remedy. The dispute centered on a challenge to the trial court's evidentiary procedure, specifically the allegation that the court violated procedural rules by relying on the testimony of the lead investigator regarding a witness's statements from the preliminary investigation phase instead of hearing the witness personally. The court held that the claimed procedural error did not affect the outcome, as the challenged testimony served merely as one of multiple corroborating indicators for the credibility of a key eyewitness; the trial court was explicitly aware of the diminished evidentiary weight of the secondary testimony and would have reached the same factual assessment had the direct witness been heard, rendering the error immaterial under § 337(1) StPO.

Volltext
