Inadmissibility of Rechtsbeschwerde in legal aid proceedings due to lack of statutory admissibility
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant's application for legal aid and the appointment of a counsel ex necessitate as inadmissible, rejected the defendant's legal complaint (Rechtsbeschwerde) against the appellate court's prior decision, and ordered the defendant to bear the costs of proceedings. The dispute concerned the availability of appellate review in a procedural legal aid (Prozesskostenhilfe) matter, where the defendant challenged the Higher Regional Court's refusal to grant legal aid after the lower court had already rejected the application due to lack of prospects of success. The court held that a Rechtsbeschwerde is not statutorily permitted in legal aid proceedings under §§ 574(1) and 127(2), (3) ZPO unless expressly admitted by the appellate court, which it was not, and noted that the non-admission of such an appeal is not subject to further challenge, unlike the non-admission of a revision; consequently, no extraordinary appeal is available.

September 2014 - I ZA 7/14, juris Rn. 2, vom 29. Juni 2015 - IX ZA 14/15, juris, vom 12.
