Legislator-Zusammenfassung

KI-generiert

The German Federal Court of Criminal Justice (4th Criminal Senate) dismissed the defendant's appeal as unfounded with respect to the substantive conviction and the forfeiture of primary contraband, but partially reversed the lower court's ruling on accessory assets. The dispute concerned a conviction for drug offenses, specifically the forfeiture of secured items including cannabis cakes, cannabis extract cartridges, and additional narcotics, packaging materials, consumption implements, and mobile phones. The decisive legal basis was Section 349 Paragraph 2 of the Code of Criminal Procedure (StPO); the court ordered that the forfeiture of the additional secured items, including packaging and consumption utensils and mobile phones, be overturned and waived, while the remaining judgments of the Landgericht Siegen dated April 22, 2024, remain in force.
