Statutory inadmissibility of legal complaint against debt enforcement ruling without leave to appeal
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the debtor's legal complaint as inadmissible at the debtor's expense and denied the application for the appointment of a legal aid attorney. The dispute concerned a ruling issued in debt enforcement proceedings, where the debtor challenged the lower court's refusal to admit an appeal. The court held that under German civil procedure law, an appeal against a decision in enforcement proceedings is statutorily permitted only if the appellate court explicitly grants leave, which had not occurred in this instance; consequently, the decision not to admit the appeal was not subject to review. The denial of legal aid followed because the legal complaint was destined to fail due to its lack of admissibility. Key legal norms included § 574 Abs. 1 Satz 1 Nr. 1 & 2 and § 577 Abs. 1 ZPO regarding the limited admissibility of appeals in enforcement matters, and § 78b Abs. 1 ZPO regarding the prospectlessness requirement for legal aid.

Die Rechtsbeschwerde gegen den Beschluss des Landgerichts Augsburg - 4. Zivilkammer - vom 17.
BGH, Beschluss vom 2. Mai 2023 - I ZB 10/23, juris Rn. 2 mwN).
II.
III. Die Kostenentscheidung beruht auf § 97 Abs. 1 ZPO.
