Criminal appeal hearing rights: Insufficiency of appellant's counter-arguments to rebut General Public Prosecutor's legal analysis
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) 5th Criminal Senate dismissed the appellant's complaint regarding a violation of hearing rights (Anhörungsrüge) against a prior Senate decision, ruling that the complaint was unfounded and bearing the costs. The dispute concerned the Senate's refusal to follow the appellant's arguments against the General Public Prosecutor's opinion in a criminal appeal procedure, specifically regarding the Senate's assessment that the appealed judgment contained no legally significant errors despite the appellant's submission of a letter. The court held that in a revised appeal proceeding under § 337 Abs. 1 StPO, the Senate is not required to conduct an independent evidence evaluation, and the General Public Prosecutor had already adequately addressed the appellant's arguments; consequently, the Senate's silence on further supplementary legal arguments signified that the appellant's submissions were insufficient to overturn the demonstrated lack of merit of the revisionary arguments, and failing to adopt the appellant's divergent legal view did not constitute a violation of the right to be heard.
