Extinction of Consumer Credit Withdrawal Right Upon Full Loan Performance Under Directive 2008/48/EC
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the plaintiff's complaint against the non-admission of revision, upholding the lower court's judgment and ordering the plaintiff to bear the costs of the appellate proceedings. The dispute concerned a consumer credit loan where the borrower alleged the right to withdraw from the contract under Article 14(1) of the EU Consumer Credit Directive 2008/48/EG after the loan had been fully performed. The court determined that the case lacked fundamental significance or the need for legal unification because, according to established European Court of Justice jurisprudence, a borrower’s statutory right of withdrawal extinguishes upon the full and complete fulfillment of the loan agreement, rendering any subsequent declaration of withdrawal ineffective.
