Evidentiary effect of inadvertent witness instruction errors and exclusion under § 136a StPO
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Criminal Court (BGH) dismissed the appeals of the defendants as unfounded, upholding the judgment of the Hamburg Regional Court from August 27, 2025, and ordered the appellants to bear the costs of their own appeals and those of the joint plaintiff. The case involved a criminal prosecution where the defendants challenged the validity of witness testimony, arguing that inadvertent erroneous instructions given to witnesses necessitated a prohibition on the use of evidence. The BGH ruled that such accidental mistakes in informing witnesses do not constitute a basis for excluding evidence under the applicable procedural codes, thereby rejecting the evidentiary challenge and affirming the lower court's decision.
