The court granted the defense attorney's application, formally determining that his travel to the Federal Court of Justice in Leipzig for the main hearing, including arrival the day before, was necessary. The dispute concerned a request for an official finding of travel necessity to justify reimbursement of travel and accommodation expenses under the German Lawyers' Fees Act, as the applicant argued that arriving on the day of the hearing was impossible due to specific transit disruptions along the approximately 500 km route. Relying on § 46 Abs. 2 RVG, the 5th Criminal Senate of the Federal Court of Justice ruled that the prior-day arrival requirement was justified, noting that the appropriateness of the actual out-of-pocket costs would be assessed at the final fee determination.
