Denial of legal aid for legal complaint: admissibility limits under § 574 ZPO and exclusion of § 522 Abs. 3 ZPO for interlocutory appeals
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the applicant's request for legal aid to pursue a legal complaint (Rechtsbeschwerde) against the Cologne Higher Regional Court's decision of January 3, 2024, holding that the intended litigation lacked a sufficient prospect of success. The dispute concerned the admissibility of a legal complaint challenging the Higher Regional Court's dismissal of the applicant's interlocutory appeal (Sofortbeschwerde) against a lower court's rejection of legal aid for an appeal. The decisive legal basis was § 574 Abs. 1 S. 1 ZPO, under which a legal complaint is permissible only if expressly provided by law or admitted by the higher regional court; neither condition was met, and the Court explicitly rejected the applicant's reliance on § 522 Abs. 3 ZPO because the higher regional court had dismissed an appeal from a procedural cost order rather than dismissing the main appeal on the merits.
