Inadmissibility of counter-remonstrance against BGH appeal decision due to mandatory lawyer representation and lack of statutory basis to modify final ruling
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the defendant's "counter-remonstrance" as inadmissible at the defendant's cost, leaving the prior court order that rejected the defendant's appeal as inadmissible unchanged. The dispute involved a procedural challenge where the defendant, in a filing characterized as a counter-remonstrance against the court's earlier dismissal of its appeal, demanded proof of the German citizenship of the judges and court staff. The decisive legal basis for the dismissal was § 78 Abs. 1 Satz 3 ZPO, which requires such submissions to be filed by a lawyer admitted to the Federal Court of Justice; the court further held that a counter-remonstrance is not a permissible remedy to modify a decision on an appeal, as the conditions for an "Anhörungsrüge" under § 321a ZPO were not met.
