Validity of withdrawing a non-admission complaint prior to service of the rejection order
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Civil Procedure (BGH) deemed the plaintiff's non-admission complaint for non-admission (Nichtzulassungsbeschwerde) for lost, rendering the lower court's rejection order of February 1, 2024, legally ineffective. The dispute concerned a non-admission complaint against a decision by the 1st Civil Senate of the Higher Regional Court of Frankfurt, which the plaintiff withdrew on February 5, 2024. The court ruled that the withdrawal was procedurally valid without the opposing party's consent because the rejection order had not yet been served upon the parties with the immediate purpose of notice at the time of withdrawal. Consequently, the ineffective rejection order was annulled under §§ 555, 269 ZPO, and the plaintiff was ordered to bear the costs of the non-admission complaint pursuant to §§ 565, 516 ZPO, with a dispute value of €63,420.29.

Februar 2020 - II ZR 130/19, BeckRS 2020, 2973 Rn. 2; Musielak/Voit/Ball, ZPO, 20. Aufl., § 544 Rn. 24a).
Der Zurückweisungsbeschluss vom 1. Februar 2024 ist damit wirkungslos (§ 555 Abs. 1 Satz 1 ZPO i.V.m. § 269 Abs. 3 Satz 1 Halbsatz 2 ZPO analog).
Die Kosten der Nichtzulassungsbeschwerde werden dem Kläger auferlegt (§§ 565, 516 Abs. 3 ZPO).
